Federal Law: THCA Is Legal Under the 2018 Farm Bill
The Agriculture Improvement Act of 2018 — commonly called the Farm Bill — legalized hemp as an agricultural commodity. It defined hemp as cannabis sativa containing no more than 0.3% Delta-9 THC by dry weight.
Since THCA is a separate compound from Delta-9 THC, and since THCA flower is produced and tested to meet the 0.3% Delta-9 THC threshold, it falls within the definition of legal hemp under federal law. This is why THCA flower can be purchased online and shipped across state lines.
The Catch: State Laws Vary
Federal legality doesn't override state law. Many states have adopted the federal hemp definition and allow THCA products. Others have created their own definitions or restrictions that effectively ban them.

Why Do Some States Ban THCA?
Some states take issue with the fact that THCA converts to Delta-9 THC when heated. These states argue that the practical effect of THCA flower is identical to marijuana, and have passed laws that account for total potential THC — meaning they factor in what THCA could become, not just what Delta-9 THC is present at the time of testing.
This is an evolving area of law, and the legal landscape continues to shift as more states revisit their hemp regulations.
